Alabama Supreme Court Affirms Summary Judgment For Product Manufacturer

On Friday, June 1, 2007, the Alabama Supreme Court issued an opinion affirming summary judgment on behalf of defendant Rockwell Automation, Inc. in a product liability lawsuit brought in the Circuit Court of Jefferson County, Alabama in 2003. The Plaintiff sought to recover for personal injuries sustained in an accident at a steel mill. The Alabama Supreme Court upheld the trial court’s ruling in favor of Rockwell on the basis that the Plaintiff’s product liability claims could not go forward because the Plaintiff failed to establish through competent evidence that any Rockwell product was defective.
