Defense Verdict for CNH America in Wrongful Death Case

After a two week trial, a Marshall County, Alabama jury returned a defense verdict in favor of CNH America on all counts in a wrongful death action. The plaintiff asked the jury to return a verdict of $21 million. The plaintiff’s husband was killed in 2005 as the result of an inadvertent activation of the boom swing on a Case model loader backhoe. Plaintiff alleged that the loader backhoe was defectively designed and also asserted claims for negligence, wantonness, breach of warranty and failure to warn. Lightfoot attorneys J.
