News from this practice

In today’s business environment, it is often necessary that companies and individuals resort to litigation to resolve disputes. Lightfoot has had extensive experience in handling plaintiff’s cases in a wide variety of areas. Nearly all of Lightfoot’s plaintiff’s cases have been business cases, which have ranged from successfully representing a small business against one of the largest business consulting firms in the country to handling a matter on behalf of a New York Stock Exchange company against a major software manufacturer. We have also represented plaintiffs in significant construction cases, disputes over ownership of energy production systems, executive compensation matters, shareholder litigation and insurance coverage disputes. These cases have been pursued both in court and through arbitration.

In our plaintiff’s practice, we are able to utilize the experience we have gained from defending literally hundreds of business clients in thousands of matters. The knowledge gained in defending businesses is invaluable on those occasions when we have been called upon to go on the offensive.

In most of our plaintiff’s matters, we are willing to explore alternative billing arrangements, with Lightfoot sharing the risk and expense attendant to all litigation.

Examples of recent plaintiff’s work include:

  • Representation of a chemical company in a dispute over a supply contract with another chemical company. The case was tried to a jury in 2012 and resulted in a $70 million judgement in our client’s favor.
  • Representation of a large manufacturer in a dispute with a software provider over the sale and installation of an ERP software system. This case was tried to a jury in 2010 and resulted in a $61.4 million dollar judgment in our client’s favor.
  • Representation of the purchaser of a majority interest in a business against the seller for breach of representations and warranties in the stock purchase agreement. The case was settled for $13 million.
