Following up on a three-week trial in February, on May 3, 2012, Lightfoot attorneys Jack Sharman, Tenley Armstrong and Jeff Doss prevailed on a motion for judgment of acquittal that disposed of all remaining counts against their client, the former CFO of a specialty pharmacy who had been charged with conspiracy and substantive violations of the federal Anti-Kickback Statute. At trial, the court dismissed three counts at the close of the Government’s case. The jury then acquitted on the conspiracy count but convicted on three substantive AKS violations. The court denied all co-defendants’ motions for judgment of acquittal but granted Lightfoot’s client extraordinary relief after extended briefing and a post-trial hearing. The trial took place in federal court in the Southern District of Alabama.
