Fifth Circuit Affirms Denial of Class Certification

New Orleans, Louisiana (February 8, 2007) -- The United States Court of Appeals for the Fifth Circuit today affirmed the denial of the certification of a class of approximately 18,000 Mississippi residents who had not been paid "inherent diminished value" in first-party auto insurance claims. The Court affirmed the District Court's findings that individual issues predominated over common issues, and that the proposed class suffered from manageability problems.
