Lightfoot attorneys Harlan Prater, Chandler Bailey and Rachel Lary received summary judgment on behalf of their client, Deere & Company, in a product liability case pending in Montgomery County, Alabama. Plaintiff claimed that he suffered personal injuries as a result of the allegedly defective design of a JohnDeere backhoe. Lightfoot successfully argued that the John Deere backhoe was not defective, that the plaintiff failed to put forth sufficient evidence of an overall safer, alternative design as required under the Alabama Extended Manufacturer's Liability Doctrine, and that the plaintiff's injuries were not proximately caused by the allegedly defective design. After briefing and oral argument, the Montgomery state court entered summary judgment in Deere's favor, dismissing all of plaintiff's claims.
