Securing $61 million jury verdict for pet food manufacturer in fraud lawsuit against software provider.
A Franklin County, Alabama jury returned a verdict of $61,381,343 in favor of our client, a pet food manufacturer, against a computer software company and its subsidiary. This was the largest verdict in Alabama in 2010. The fraud lawsuit was related to our client's purchase of manufacturing software from the defendant. We alleged that the defendant misrepresented the capabilities of its software during the sales process and that it performed a sales demonstration that made it appear the software had capabilities its software did not actually have. After a three week trial and two days of deliberations, the jury returned a verdict of $16,381,343 in compensatory damages and $45,000,000 in punitive damages.
