Service Corporation International Obtains Dismissal of Federal Antitrust Claims

Lightfoot attorneys John M. Johnson and Jonathan R. Little obtained a Rule 12(b)(6) dismissal of federal antitrust claims brought against Service Corporation International, a national cemetery property and services company, and its Alabama subsidiary, in a case filed in the Northern District of Alabama.
The complaint alleged various theories relating to monopolization and illegal tying arrangements under Section 2 of the Sherman Act, as well as state antitrust laws and business interference claims. Ultimately, the court entered an order dismissing the federal antitrust claims for failure to state a claim and declined to exercise supplemental jurisdiction over the remaining state law counts.
