Lightfoot Secures Win in Tennessee Court of Appeals

March 11, 2020

Lightfoot, Franklin & White LLC partner Rachel M. Lary and associate Benjamin S. Willson won an appeal before the Court of Appeals of Tennessee for a national financial services company. The matter was an appeal of a defense win they previously secured dismissing consumer fraud claims against their client in the Chancery Court of Hamilton County, Tennessee. The plaintiff appealed arguing the trial court’s dismissal as a matter of law was in error.

Lary argued the case before a three-judge panel. Following oral arguments, the Court of Appeals affirmed the trial court’s decision to dismiss.

Lary’s practice includes defending against consumer fraud allegations in states across the Southeast. She is licensed in Alabama and Mississippi. In addition to her business ligation practice, she defends automotive manufacturers in product liability actions.

Willson focuses on white-collar criminal defense, corporate investigations, product liability and other complex areas of litigation. Before joining Lightfoot, he served as an active duty Marine for eight years, deploying twice to Iraq and once to Afghanistan.
