Lightfoot Wins Summary Judgment in Georgia State Court

Lightfoot, Franklin & White LLC partners J. Chandler Bailey and Christopher C. Yearout, along with associate Charles M. Stam, secured a summary judgment on behalf of Techtronic Industries North America, Inc., (TTI-NA) and One World Technologies, Inc. (One World) in Georgia state court.

The case involved a commercial trucking accident in Atlanta, in which the plaintiff alleged that an improperly loaded and “top heavy” cargo container shifted and caused his truck to roll over while navigating an exit ramp, causing him personal injuries. The Lightfoot team moved for summary judgment on behalf of TTI-NA and One World, arguing that the plaintiff failed to present sufficient evidence to support his claims against our clients. The trial court agreed and granted summary judgment in TTI-NA and One World’s favor as to all of the plaintiff’s claims.

Bailey represents product manufacturers and suppliers around the country in high-stakes cases involving catastrophic injuries and wrongful death. He has served as national and regional counsel for several of the country’s largest companies, representing them in serious, high-exposure lawsuits in more than 20 states. Bailey has practiced law for nearly 20 years. Benchmark Litigation recognizes him as a “Local Litigation Star” (2017-20).

Yearout is a trial lawyer who defends companies in a wide array of product liability, catastrophic injury and other complex cases in state and federal courts across the country. His practice also includes medical malpractice, commercial and toxic tort litigation. Since 2014, Yearout has been recognized by Super Lawyers as a “Rising Star” for his product liability defense work.

Stam maintains a general litigation practice focusing on corporate plaintiff’s litigation, complex government litigation and investigations, commercial litigation, and product liability / catastrophic injury claims. He joined Lightfoot after completing a one-year clerkship with Judge Debra M. Brown, U.S. District Court for the Northern District of Mississippi, Greenville Division.
