Securing defense verdict in $21 million wrongful death lawsuit.

After a two-week trial, a Marshall County, Alabama jury returned a defense verdict in favor of our client on all counts in a wrongful death action. The plaintiff asked the jury to return a verdict of $21 million. The plaintiff’s husband was killed in 2005 as the result of the inadvertent activation of the boom swing on a backhoe manufactured by our client. The plaintiffs alleged that the loader backhoe was defectively designed and also asserted claims for negligence, wantonness, breach of warranty and failure to warn.
