We speak “pilot.”

Aviation cases are different. They involve highly technical equipment and systems, as well as witnesses who often speak an entirely different language that we like to call “pilot.” At Lightfoot, we use our deep understanding of the aviation industry, flight characteristics and human factors to develop our clients’ stories. We also have a comprehensive understanding of the specific laws governing this highly regulated sector, from the General Aviation Revitalization Act (GARA) to the Montreal Convention. While the technical nature of these cases can create unique civil litigation and regulatory challenges, our attorneys’ combination of skills enables them to find the best solutions for aviation and aerospace clients.

Members of the Lightfoot Aviation & Aerospace practice group include commercial-rated and fixed-wing pilots, former military pilots and engineers. All have deep experience in complex commercial, catastrophic injury and product liability cases.

A significant portion of Lightfoot’s aviation industry practice is the defense of aircraft and component part manufacturers in litigation arising out of accidents. We handle all aspects of these cases, navigating the myriad of related legal issues, including industry-specific regulations that arise during aviation crash investigations and civil litigation.

We also represent airline fixed-base operators, corporate hangars, corporate aircraft operators, airframe and powerplant mechanics, and aerospace defense contractors in litigation arising from all aspects of their operations. This includes commercial disputes, employment matters, TSA and FAA issues, and premises liability and general negligence actions. We also regularly advise owners and operators on how to avoid litigation troubles before they arise.

Representative Matters

Counterclaiming against an international plaintiff for a trade secret and breach of contract claim. The plaintiff voluntarily dismissed claims against our client and settled the counterclaim. 

Defending an aerospace parts and service supplier in a trade secrets civil lawsuit in Georgia. There was also the potential for criminal charges. Our work resulted in a dismissal of the civil complaint and no criminal charges being filed against the client.

Obtaining summary judgment for the leasing and financing arm of an aircraft manufacturer in a fraud and breach of contract case surrounding a sale and leaseback arrangement with a potential buyer.

Reaching a favorable settlement for a globally recognized aircraft engine manufacturer suing a component manufacturer for breach of contract.

Obtaining summary judgment for a general aviation aircraft manufacturer in a product liability action related to a fatal plane crash near Angel Fire Airport in New Mexico.

Obtaining summary judgment for an aircraft manufacturer in a product liability case in Florida state court. We were later retained to represent an A&P mechanic sued for negligence in the same litigation and negotiated a favorable settlement.

Representing a general aviation aircraft manufacturer by handling the experts and fire investigation for litigation surrounding a fatal accident in California.

Obtaining summary judgment for a general aviation aircraft manufacturer in a lawsuit related to a fatal accident in Tegucigalpa, Honduras.

Obtaining summary judgment for a general aviation manufacturer for a wrongful death claim arising out of aircraft climb performance and FAA certification issues. 

Representing a component part manufacturer in a case after it lost key pre-trial motions under its former representation. We negotiated a favorable settlement.

Negotiating a favorable settlement for an international air carrier in a lawsuit filed pursuant to the Montreal Convention.

Reaching favorable settlements in three wrongful death actions involving the crash of a corporate aircraft conducting a training flight.

Securing summary judgment for an aerospace defense contractor in a dispute with a former employee.

Representing a fixed-base operator in a fraud and breach of contract case arising out of the marketing and sale of an aircraft.

Representing a major commercial airline in a negligent hiring and supervision suit brought by a passenger.

Representing an aerospace coating manufacturing and systems integration company in a trade secrets case against former employees, resulting in a favorable resolution and judgment in favor of the client.
