Driving the case to do the thing.

The shortest answer is doing the thing. – Ernest Hemingway

In Economics, what Hemingway refers to is called the equilibrium – where resources and goods supplied intersect to meet the demands of the market, achieving the desired result without excess or shortage. At Lightfoot, there is also an equilibrium. It is where persuasive lawyering and zealous advocacy intersect with efficient research and effective legal writing to meet the demands of each new case.

Driving each new case to do the thing has allowed Jonathan to successfully achieve his clients’ goals early in his practice. Such results include:

  • Rule 12(b)(6) dismissal of federal antitrust claims against a nationwide cemetery and property service company in the Northern District of Alabama;
  • 2nd Chair and put up witness during arbitration in which former employee sought $10 million in damages against nationwide provider of insurance and investment products and services and obtained complete judgment for defense;
  • Emergency injunctive relief on behalf of online and print media organization resulting in the release of over 7,700 pages of public records relating to fatality during the Terminal Modernization Project at the Birmingham International-Shuttlesworth Airport;
  • Briefed, argued, and won motion to enforce forum-selection clause requiring suit in Prince George’s County, Maryland on behalf of Maryland manufacturer;
  • Briefed, argued, and won motion to quash subpoena seeking the disclosure of the identities of anonymous commenters to an online news story.

Involvement and Public Speaking

Jonathan serves as the recruitment advisor on the BOT for a local fraternity chapter and coaches youth basketball and football in the community, most recently being part of a Super Bowl winning elementary school team. Jonathan is also a member of the Defense Research Institute, serves on the Executive Committee of the Young Lawyers Section of the Birmingham Bar Association, and is a member of the Birmingham Chapter of the W&L Alumni Association.

Recent public speaking events include:

  • Speaker at the Alabama Scholastic Press Association’s State Convention 2015 at the University of Alabama, addressing school groups from across the state about various First Amendment issues relating to print and digital media.
  • Co-presenter at the 2014 MLRC/NAA/NAB Media Law Conference in Reston, VA, leading discussion on current First Amendment topics in areas such as defamation, publication torts, and Section 230 Immunity.
  • Speaker at the 2014 Free Speech Week at the University of Alabama, addressing undergraduate and graduate students in the Department of Journalism.

Education and Work

Jonathan joined Lightfoot in September 2012 and has represented clients in many areas of civil defense litigation including product liability, premises liability, toxic torts, public record and first amendment disputes, and business and commercial cases. He earned his J.D. from Washington and Lee University School of Law, where he competed with, and coached, the school’s Philip C. Jessup International Law Moot Court Competition team. Jonathan served as Chair of the Moot Court Executive Board and received the Charles V. Laughlin Award from the faculty for his significant contribution to the program. As a member of the Black Lung Clinic, he reached his clients’ goals by successfully briefing an appeal at the agency review level, which the Fourth Circuit upheld and declined to review by opinion, as well as utilizing motion practice to take an expert deposition which drove another client into pay status.

Jonathan received his Bachelors of Science in Economics and his Masters of Arts in Applied Economics from the University of Alabama. Before law school, he worked as a risk management analyst at BBVA Compass in Birmingham.

Outside of the office, Jonathan enjoys spending time at the lake with his wife (Katie), three sons (Jack, Sam, and George), and extended family, fishing with bobbers and worms and jumping off the dock to see who can make the biggest splash. According to sources, Jonathan usually makes the biggest splash.
